Terms of Service

These terms apply when you use 3dbooks.com, operated by 3DBooks.com from Burlington, Ontario, Canada ("we", "us"). By creating an account, creating a card or otherwise using the service, you agree to them. If you do not agree, please do not use the service.

Your account

Keep your sign-in details private. You are responsible for everything that happens under your account. You must be at least 13 years old to create an account, and at least the age of majority where you live to make a purchase.

Your content and what you may not upload

You keep ownership of the photos and other content you add ("your content"). You give us a non-exclusive, worldwide licence to store, copy, resize, process and display your content only as needed to run the service, for example to show your card to the people you share it with, and to keep backups.

You are solely responsible for your content. By uploading it you confirm that:

• you took the photo or otherwise have the right to use and share it, including the permission of any people shown in it;
• it does not show nudity or sexual content, violence, self-harm, drugs, weapons presented for intimidation, or anything illegal;
• it is not hateful, harassing, threatening, defamatory or discriminatory, and does not target a private individual;
• it does not show a child other than your own without a parent's or guardian's consent, and never in a sexualised way;
• it does not infringe anyone's copyright, trademark, privacy or publicity rights;
• it contains no spam, advertising, malware, or links designed to mislead.

Card greetings are chosen from a list we provide; you may add a short signature such as your name. The signature may not contain anything from the list above or any message directed at a specific person.

Our role and moderation

3dbooks.com is a tool for sending personal greeting cards. We do not review cards before they are shared and we are not the publisher of your content. We may, but are not obliged to, review content at any time. We may remove content, disable links, suspend or close accounts, and refuse service, without notice and without refund, if we reasonably believe these terms have been broken or that content is harmful or unlawful. We may also report unlawful content to the appropriate authorities.

Reporting content

Every card carries a "Report" link. If you believe a card infringes your rights, shows you without your consent, or breaks these terms, email abuse@3DBooks.com with the card link and a short description. For copyright claims, include a description of the work, where it appears, your contact details and a statement that you believe in good faith the use is unauthorised. We will act on valid reports promptly, normally by disabling the card.

Sharing cards

Anyone with a link to your card can open it while the link is valid (30 days). You are responsible for who you share links with. Only send cards to people who would expect to hear from you; do not use the service to send unsolicited bulk messages.

Paid features

Some features may be offered for a fee. Prices and what each purchase includes are shown before you pay. Payments are processed by Paddle, our merchant of record, under its own buyer terms. Purchases unlock a digital feature immediately. Refunds are handled as described in our Refund Policy.

The service

We work hard to keep 3dbooks.com available and working well, but the service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose. We cannot promise it will always be uninterrupted or free of errors, and we may change, suspend or stop features over time.

Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental, special or consequential losses, or for loss of data, arising from your use of the service or from any content other users create or share. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim and CAD 20. Nothing in these terms limits liability that cannot be limited by law, or rights you have under consumer protection law that cannot be waived.

Your responsibility for your content

If a third party makes a claim against us because of content you uploaded or shared, or because you broke these terms, you agree to compensate us for the reasonable costs and damages that result, including legal fees.

Ending your use

You can stop using the service and ask us to delete your account at any time. Deleting a card removes its photos and stops its links from working. We may suspend or close accounts that break these terms.

Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Disputes will be heard in the courts of Ontario, unless consumer law gives you the right to bring a claim elsewhere.

Changes

If we change these terms in an important way, we will update the date at the top of this page. Continuing to use the service after a change means you accept the new terms.
